We ask that you read our Terms and Conditions prior to completing your order, as you will be asked to confirm that you have read and understood these before your booking can be confirmed.
Please note that when your booking has been confirmed, Baby Concierge will charge you for the amount due for the entire Hire Period (as defined below). By acknowledging this Agreement, Renter also authorises Baby Concierge to charge you for any late returns, late cancellations, lost, stolen, broken, or non-returned equipment, and for all other amounts payable under the terms and conditions of this Agreement.
Article 1 – Definitions
Agreement shall mean contract entered in to between Baby Concierge and Customer.
Equipment shall mean the baby and /or children’s equipment being hired.
First Hire Day and Last Hire Day shall mean the first and last days respectively on which the Equipment is being hired by Customer.
Hire Period shall mean the period during which the Equipment is being hired and will commence on the First Hire Day and terminate on the Last Hire Day.
Article 2 - Parties
This agreement is entered into with Baby Concierge and Customer.
Article 3 - Booking Conditions
Booking Date: Baby Concierge can accept bookings with at least 24 hours’ advance notice and made up to 12 months in advance.
Minimum hire duration: The minimum hire period is 1 day and hires of less than 24 hours will be charged at a full day's rate.
Maximum hire duration: The maximum Hire Period is 4 weeks.
Subject to Availability: Baby Concierge will take all reasonable efforts to provide the customer with the Equipment that has been ordered. However, please note that due to unknown factors such as Equipment not being returned on time, insufficient lead time, lost, broken or stolen equipment etc., all of our equipment is subject to availability. If the equipment required is unavailable, we will endeavor to replace it with Equipment of the same standard that is suitable to fulfil the same purpose.
Article 4 - Delivery and Collection
Baby Concierge will deliver the equipment at a time convenient to both parties on the First Hire Day or earlier (by agreement). We will collect, or you may return the equipment on the agreed date at a time convenient to both parties.
The customer is responsible for checking the equipment immediately upon delivery to ensure it is undamaged, in good working order and fit for its intended purpose. You will notify us on the day of delivery if this is not the case. Instructions will be supplied with all equipment, where these have been supplied by the manufacturer, and you are responsible for reading these carefully prior to using the equipment and for complying with these instructions whilst using the equipment.
All hired Products must be returned on or before the return date listed on this agreement and in good clean condition (to our satisfaction).
Article 5 – Obligations
Obligations of Baby Concierge are to:
- Deliver the Equipment on the First Hire Day, subject to booking conditions outlined in Article 3.
- Ensure that the Equipment is fit for purpose to fulfil its objective.
Customers Obligations are to pay the price referred to in Clause 6, and:
- Not to use the Equipment for different purposes.
- Not to use the Equipment imprudently.
- Allow Baby Concierge to examine the equipment at any time.
- Allow any urgent repairs to the equipment.
- Inform Baby Concierge immediately if there is any fault or defect.
- Inform Baby Concierge immediately if your car is in an accident whilst using a Baby Concierge car seat.
- Return the equipment in its initial condition on the Last Hire Day.
Repossession of Equipment: Baby Concierge reserves the right to request the return of the Equipment or to repossess the Equipment if you do not comply with your obligations as above, or if the Equipment appears to be abandoned. In the event of repossession, Baby Concierge reserves the right to charge your PayPal account for the full Hire Period or for any period thereof.
Article 6 – Prices:
All prices shall be as listed on the website and are subject to change without notice. The prices are guaranteed for the hire associated to the confirmed booking.
Additional charges may be imposed in the following situations:
Damages & Theft: Up to the limit of the Equipment’s manufacturer's suggested retail price.
Failure to Return the Equipment: Failure to return the Equipment for any reason on the Last Hire Day or when requested to do so by Baby Concierge, will result in Customers being charged the full amount of the manufacturer's suggested retail price for the Equipment, in addition to any charges for the Hire Period.
Article 7 – Payment and Confirmation:
Once the order has been placed a confirmation email will be sent within 48 hours to inform and confirm availability of Customers order. We advise that this confirmation is checked thoroughly, and any queries or errors are notified to Baby Concierge within 48 hours of receiving such information. If we receive no notification, then we will assume that the order details are correct, and confirmation of the order will be affected as agreed.
Baby Concierge’s method of payment will be by Bank Transfer or PayPal and this will be for the full amount due for the entire Hire Period together with a refundable deposit (£50) when you make your online booking and by accepting this agreement you hereby authorise this charge. In addition, by accepting this agreement, you also authorise Baby Concierge to charge you for any late, lost, stolen, broken, or non-returned equipment in accordance with Article 6 and for all other amounts payable under the present Terms and Conditions.
Provided the goods are returned in the same condition as they were received then the £50 deposit shall be returned to you in full. In the event of the late return of any equipment, we shall be entitled to retain the deposit paid or part there of i.e. the daily hire rate.
Method of Payment as stated above will be by secure Bank Transfer or PayPal, unless otherwise arranged.
Article 8 – Changes to Reservations:
This Agreement may be cancelled at any time by notifying Baby Concierge by e-mail (email@example.com) of your intention to cancel. Equipment can only be cancelled by email, and phone cancellations will not be accepted. In the case of cancellations, the following refund policy applies:
- A full refund is administered for cancellations of up to 24 hours’ notice or more.
- No refund will apply to bookings cancelled less than 24 hours from date of pick up.
- Please note any early returns upon your own choice after the commencement of the Hire Period will not be entitled to any refund.
Equipment that is scheduled to be picked up will be kept for 12 hours and then cancelled (unless rebooked). If the equipment is not picked up, no refund will apply.
Booking Amendments & Extension of Hire Period:
Baby Concierge will endeavor to accommodate any changes that you may wish to make to your booking, including any extensions that may be required to the Hire Period. Please note, however, that any such changes are subject to availability.
Article 9 – Damages & Equipment Condition
If the Equipment is returned damaged or in disrepair, excessively soiled or stained or has missing parts, Customer is obligated to pay the cost of repair in addition to charges incurred for the rental period or Baby Concierge reserve the right to retain the deposit paid by you (£50).
If the item is irreparable, Renter is obligated to purchase the Equipment at full retail replacement value.
Food and drinks are not allowed in any of the equipment with the exception of the high chair and feeding booster seat.
Article 10 – Liability
Customer agrees not to hold Baby Concierge (and its owners) liable against any and all claims, liabilities, including negligence, liabilities, demands, actions, suits and proceedings, losses, costs, penalties, and damages, connected with, or resulting from the manufacture, selection, hire, purchase, delivery, possession, condition, use, operation, handling, transportation, or return of the equipment.
Subject to the provisions of the Unfair Contract Terms Act 1977 (as amended), we are not responsible for any injury, loss or claim arising out of the use of the equipment. Any failure by us to enforce any or all of these conditions shall not amount to or be interpreted as waiver of any of our rights. In case of any disputes the law applicable would be based on the UK Governing Law.
Baby concierge are not liable for any indirect or consequential losses and will have no liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising under or in connection with this Contract.
Article 11 – Miscellaneous
Baby Concierge cannot accept responsibility for any failure or delay on our part to fulfil our obligations where such failure/delay is caused by circumstances beyond our control.
All equipment supplied to you shall remain the property of Baby Concierge.
Article 12 – Privacy
Baby Concierge are committed to maintaining the trust and confidence of visitors to this web site. We will not sell, rent or trade personal data with other businesses for marketing purposes. We will only collect information that is necessary and relevant to the contract. We will only use personal data to fulfil the contractual obligations between ourselves and the Customer.
We will keep all your personal information confidential. We do not share personal data with any third parties. All personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
